Unless expressly stated otherwise, ArtBee makes no warranties about the copyright status, public domain status, or any other legal aspects of the artworks available on this platform and cannot guarantee the accuracy of any information provided.

You are responsible for your own use. You may find additional information about the copyright status of artworks on the websites of the museums that have made them available.

DISCLAIMER: The purpose of this website is to help the public discover and access artworks that we believe may be in the public domain. This website does not constitute legal advice and should not be used as a substitute for consultation with a legal professional. When there is a license or rights statement from a source museum, this site only summarizes the effects of some of its terms.

1. Acceptance of Terms

By accessing and using ArtBee ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

ArtBee is operated by ArtBee ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Content and Copyright Disclaimers

2.1 Public Domain Belief

ArtBee aggregates artwork metadata and images from museums and cultural institutions that have designated works in their collections as being in the public domain or available under open access policies. To the best of our knowledge and based on information provided by source institutions, we believe the artworks on this platform are in the public domain.

2.2 No Ownership Claims

ArtBee does not own the rights to the artworks displayed on this platform. We do not claim any copyright, trademark, or other intellectual property rights in the artworks themselves. All artworks are attributed to their respective artists and source institutions.

2.3 No Authority to Grant Permission

ArtBee cannot grant or deny permission to use artworks. We do not have the authority to license, sublicense, or otherwise authorize the use of any artwork. Any permissions or restrictions regarding artwork use must be obtained from or determined by reference to the source museum or relevant rights holders.

2.4 Information Accuracy

While we strive for accuracy, metadata and information about artworks (including artist names, dates, titles, dimensions, and copyright status) is provided by third-party sources and may contain errors, omissions, or become outdated. We make no representations or warranties about the accuracy, completeness, or reliability of this information.

3. NO WARRANTIES

The Service and all content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

We specifically disclaim all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding the accuracy, reliability, or completeness of any content
  • Warranties that the Service will be uninterrupted, secure, or error-free

5. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall ArtBee, its affiliates, officers, directors, employees, agents, or licensors be liable for any damages whatsoever.

This includes, but is not limited to, damages arising from:

  • Any errors, omissions, or inaccuracies in content or metadata
  • Unauthorized access to or alteration of your data
  • Any third-party content, conduct, or services
  • Copyright infringement claims arising from your use of artworks
  • Reliance on information provided through the Service

This limitation applies to all claims, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

6. Indemnification

You agree to indemnify, defend, and hold harmless ArtBee and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of the Service or any artwork obtained through the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including copyright, trademark, or privacy rights
  • Any claim that your use of an artwork infringed a third party's rights

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate in asserting any available defenses.

7. DMCA Copyright Policy

ArtBee respects the intellectual property rights of others. If you believe that material available on the Service infringes your copyright, you may submit a notice pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information:

7.1 DMCA Notice Requirements

  • A physical or electronic signature of the copyright owner or authorized agent
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material claimed to be infringing, with sufficient detail to locate it on the Service (e.g., artwork UUID or URL)
  • Your contact information (address, telephone number, email address)
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

7.3 Counter-Notice

If you believe material you posted was wrongly removed due to a DMCA notice, you may file a counter-notice containing:

  • Your physical or electronic signature
  • Identification of the material removed and its prior location
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  • Your name, address, phone number, and consent to jurisdiction of federal court in your district

7.4 Repeat Infringer Policy

We will terminate accounts of users who are repeat copyright infringers in appropriate circumstances.

8. Third-Party Content and Links

The Service may contain links to third-party websites, including source museums. We do not control, endorse, or assume responsibility for third-party content or services. Your interactions with third parties are solely between you and the third party.

You should review the terms and privacy policies of any third-party sites you visit.

9. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.
